Last month, Marks and Spencer claimed that Aldi infringed its copyright with its Cuthbert the Caterpillar cake. Since then, the two supermarkets have taken the battle to social media for all to see, and there are no signs of it coming to an end.
Despite Cuthbert the Caterpillar returning to Aldi stores on May 17, the drama between both supermarkets has not stopped.
In fact, Aldi has found more ways to keep its caterpillar product in the news.
Posting on social media recently, the discount retailer encouraged its customers to create a new product using its Cuthbert the Caterpillar cake.
Aldi has many recipe ideas on its website for its customers to try, and shoppers have said that the latest one looks suspiciously like a Marks and Spencer product.
Aldi posted an image of Cuthbert the Caterpillar in a glass jar on its Instagram, as well as instructions on how to make the dessert at home.
The supermarket said: “Ready to take your Caterpillar Cake love to the next level?
“These Caterpillar Jars are the perfect treat for when you want a little more than just a slice.
“Easy to make and perfect for entertaining, go on give them a try!”
However, customers were quick to point out that the cake jars look very similar to one of Marks and Spencer’s iconic products: the Colin the Caterpillar cake jars.
M&S has three cake jars available in its dessert range, including a Colin the Caterpillar version.
The single-serving jars went on sale for the first time in April and sold out quickly due to popular demand.
They were introduced to stores again earlier this month, with M&S doubling their quantities so more people would have the opportunity to buy them.
Although Aldi has not launched Cuthbert the Caterpillar cake jars, the recipe it posted showed customers how to make their own versions at home.
These seemed exactly the same as Marks and Spencer’s models.
Many customers commented on Aldi’s post to point out the similarity. One person wrote: “Aldi doesn’t know when to stop.”
Another person said: “Oh no they didn’t just copy the cake jars too.”
One person wrote: “The war is on.”
“Aldi at it again haha…M&S do these jars too,” one person noted.
Another person said: “How are they getting away with this?!”
Aldi shared recipes for three different types of Cuthbert cake jars: Toffee & Chocolate Cuthbert Jar, Lemon & Chocolate Cuthbert Jar, and Strawberry & Cream Cuthbert Jar.
M&S offers an original Colin the Caterpillar chocolate cake jar, as well as a Raspberry Ripple cake jar and a Trillionaire’s cake jar.
