Filming on Rust will resume this week amid Alec Baldwin’s ongoing lawsuit, it has been claimed.

The 65-year-old was charged with involuntary manslaughter earlier this year after he accidentally shot and killed cinematographer Halyna Hutchins on the set of the flick in New Mexico, in 2021.

Following the incident, in which director Joel Souza was also injured, production came to a halt while an investigation was carried out.

A spokesperson for the production has told CNN that principle photography is set to continue on Thursday.

As well as Baldwin, Souza is also returning to complete the project, which has moved from the original New Mexico location to Yellowstone Film Ranch, in Montana.

The outlet reports that the production has barred ‘any use of working weapons and any form of ammunition’ from the set.

‘Though bittersweet, I am grateful that a brilliant and dedicated new production team joining former cast and crew are committed to completing what Halyna and I started,’ Souza previously said in a statement.

‘My every effort on this film will be devoted to honoring Halyna’s legacy and making her proud.

‘It is a privilege to see this through on her behalf.’

Baldwin has been charged with two counts of involuntary manslaughter after a prop gun he was holding discharged, leading to Hutchins’ death.

He pleaded not guilty and has always maintained that he was not aware that the gun had a live round.

The production’s armourer, Hannah Guttierez-Reed, is facing the same charges.

A preliminary hearing is due to begin on May 3, but a waiver filed by Baldwin’s legal team was approved by judge Mary Marlowe Sommer, meaning he won’t have to show up in person.

‘I understand that I am charged with the following offence or offences under the law of the State of New Mexico: Involuntary Manslaughter … in two alternatives,’ it read.

‘I understand that I am entitled to personally appear before the court at every stage of the criminal proceedings.

‘After reading and understanding the above, I request that the court permit me to waive a personal appearance in court for the following proceedings: preliminary hearing’.

During the hearing, which is set to last for two weeks, it will be decided whether there is evidence for the case to proceed to a full trial.
